1.- OBJECT

This legal notice tries to regulate the availability to the users of the information and the services that are provided through the web page www.redxlasalud.org, property of Medicos del Mundo , with quarters in Calle Conde de Vilches 15, 28028, Madrid, con CIF; G-79408852, registered on the National Register of associations, under the number 91.009 and declared of public utility according to the Ministerial Order of 17/10/1995.

The browsing through the website gives the condition of user and entails the full acceptance and without reserves of the given Legal Notice. The access to the information shown in the pages of the portal is completely free, unless the contrary is specifically stated.

Medicos del Mundo, reserves the right to modify unilaterally the appearance, configuration and content of the website and the given Legal Notice, at any moment and without previous notice.

2. ACCESS CONDITION AND UTILIZATION.

 

• User status: Non registered user

The Access to the information and to specific contents provided by www.redxlasalud.org constitutes the user’s status not registered in it. This status with the authorities that its entails (visualizing contents specified as public; home, events, resource centres…), it can be acquired through the simple access to the portal, without requiring of any personal details, nor the utilization of passwords, nor the prior subscription.

 

• Non registered user: requirement to register
  

In general matter a prior register will be necessary, to have access to specific content or for the use of specific services ( containing information, images, videos, documents, news, audio recordings or files of any type, used for its incorporation in the different tools such as blogs, forums, groups, expert’s consulting, wiki and the resource centre, …)
The user, with intentions of using these mentioned services, will have to supply his/her personal details, ensuring these being true, exact, authentic and up to date. MEDICOS DEL MUNDO, as owner of www.redxlasalud.org, will give these personal details the automatic treatment it corresponds, based on its nature or end, stated in the conditions and terms in the section of privacy protection of personal details.

Accordingly, in these cases, if the use of access codes ( username and password), the users will have to bear in mind the following:

 

• The password chosen by the user cannot be against the moral and the good customs generally accepted, neither can it harm the rights to the honor and the own image of others, nor trespass the property of industrial or intellectual rights of others.
• The access codes are for personal and exclusive use of its holder, and  the custody, confidentiality and right use of these fall under the user’s exclusive responsibility.

• MEDICOS DEL MUNDO as owner of www.redxlasalud.org,  is committed to follow with the duty of privacy respecting the password chosen by the user.

Before completing the User Register, he/she will be asked to read the information about the Data Protection and the Law of Services of the Information Partnership.

3. USERS ‘OBLIGATIONS

3.1.- Obligations of non registered users.

The user agrees to use the contents diligently, correct, licit and according to the moral or public order Law and in accordance with the given Legal Notice.

The non registered users in particular, agree to neither distribute, nor transform and nor modify the content of the webpage, excepting when he/she has the express authorization and in any type of support, physical or logical, of Medicos del Mundo or with its express authorization, in its case, of the legit holder of the rights over the content previously mentioned.

Accordingly, the user agrees to not use the design and source code of the WebPages with an end against the moral and public order Law.

3.2.- Obligations of registered users

Medicos del Mundo Spain, as established in the previous section, offers to the registered users to the online platform Red x la Salud, the possibility to collaborate taking part and managing the contents of the portal www.redxlasalud.org, contributing information, images, videos, documents, news, audio recordings or files of any other type, for its incorporation to the different tools such as blogs, forum, groups, consulting of experts, wiki and resource centre.

The users profile is subject to the following terms and conditions, of which fulfillment the user is the only and exclusive responsible:

 

I.- The registered user, who sends files, declares and guarantees to be the legit holder of the same and, therefore stands with full legitimacy to yield to Medicos del Mundo the property of intellectual rights over the files. The user is the sole responsible, and will leave Medicos del Mundo unscathed from any type of legal judicial or extrajudicial, for the incompliance of this warranty which, could be presented by others in the future.

On the other hand, the registered user, who is not the author of the files, guarantees that those submitted for its publishing are not protected by any type of rights of intellectual or industrial property owned by others,  without having prior obtained from its holders the authorization needed to be able to use it as it is meant to.
When the files are sent or downloaded at the resource center, there will be the need to quote the source of origin of the resource ( document, image, podcast or video)

II.- The user yields to Medicos del Mundo with exclusivity and for all the time legally permitted all the rights of reproduction, distribution, transformation and public communication over the files for their use en all the modalities of existing use at the moment of yield. Medicos del Mundo declares expressly that it reserves the right to use the files yielded, apart from its publication in the prior mentioned websites, for the carrying out of exhibitions o editing of books, catalogs or analog literature, in physical, digital support, or any other method or support, which allows its reproduction, distribution and/or public communication.

III. -The user agrees that the files subjected to yield :

 

• Do not contravene, underestimates or goes against the public fundamental rights and liberties recognized constitutionally.
•  Are not false, ambiguous, inexact, exaggerate or untimely, in a way that the can cause an error about its object or about the intentions or purpose of the communicant.
• Are not contrary to the honor rights, personal and familiar privacy or the own image of the people.
• Do not incorporate criminal, violent or degrading messages.
• Do not provoke though its characteristics (format, extension…) difficulties in the normal functioning of the Services.

Medicos del Mundo is legitimized to immediately abort the provision of service to the access to the web, of opinions, information’s, comments, images and in general, of any type of material that harms what is disposed in this document.

The user will answer versus Medicos del Mundo for the incompliance of any of the obligations to which he/she is subjected by Law and the given compromise.

The user will answer, and will leave Medicos de Mundo unscathed, for the harm that derived from what the incompliance of these obligations may produce to others.

As Medicos del Mundo has effective knowledge that the actions the user is performing are contrary to what is disposed in these conditions, it will be allowed to unsubscribe the user without the need of prior notice, reserving the exercise of the legal actions that are appropriate.

 

4. EXCLUSION OF RESPONSIBILITY

Medicos del Mundo does not guarantee the availability and continuity of the functioning of the website and excludes any type of responsibility for the harm and prejudice of any nature that can occur due to the lack of availability and continuity of the functioning of the webpage or the fraud that the users might have attributed to the website. In particular, Medicos del Mundo will not take any kind of responsibility for the possible failures to access the different pages of the website of its ownership.

Medicos del Mundo does not guarantee the reliability and utility of all the contents of the website and excludes of any responsibility for the harm and prejudice of any nature that can occur due to the transmission, diffusion, storage, availability, reception, obtaining, access or any other analog conduct or similar of the contents.  Medicos del Mundo does not guarantee the veracity, correctness, completeness and update of the contents.

Medicos del Mundo excludesfrom any type of responsibility for the harm and prejudice of any nature that can be due to the lack of veracity, correctness, completeness  and /or update of the contents, as well as the relative to the insults, slander and damage to the honor and the image to the physical or juridical people that the users could spread in the webpage, without prejudice that after receiving the corresponding claim from the affected, Medicos del Mundo can carry out all the actions to disable or cancel the documents, opinions, that can fall into the assumptions previously foreseen.

 
5. ANCHORED SIRES

The website can include technical devices of linkage that allow the user to access to other pages and portal. ( In the future “ Anchored sites”) In these cases Medicos del Mundo acts as a provider of services of intermediation according to the article 17 on the Law 34/2002, of 12th July , of Services of the Information  and Electronic Business Society (LSSI) and will only be responsible for the contents and services provided in the Anchored Sites as it gains effective knowledge of the wrongfulness, and if it has not deactivated the link with the diligence needed.

Medicos del Mundo has no knowledge of the contents and services of the Anchored Sites and therefore, takes responsibility for the harm done for the wrongfulness, quality, unavailability, error and inutility of the Anchored Sites, nor for any other harm that is not directly attributed to Medicos del Mundo.

6.- BROWSING WITH COOKIES

The web of Medicos del Mundo uses cookies that will be stored in the computer. The cookies are small files that our computer sends to Yours, but they do not provide us with information about Your name or any other personal detail.

The cookies that we use cannot read data from Your computer, nor read the cookies that exist in Your computer. When the user browses through the Web of Medicos del Mundo the server where it is hosted recognizes automatically the IP address of Your computer, the date and time at which the visit starts, when You leave the page, as well as information about the different sections consulted. The rights of intellectual property of the Web www.redxlasalud.org and the different elements in the contents, including, without limitation, the information written, the graphic designs, drawings, image and sound files, photographic designs, recording and, in general all the material accessible through the Web owned by Medicos del Mundo Spain, either as author of the quoted contents or as lender of these. It corresponds to our NGO the exclusive exercise of the rights of exploitation of those rights of intellectual property, in any way and in specifically, the rights of reproduction, public communication and transformation.

The use of the information held in this Web, with end that go against the moral and moral Law or degrading or harming for the NGO Medicos del Mundo, as well as the injury to the rights of Intellectual or Industrial Property of Medicos del Mundo, will lead to the legally established responsibilities.

The user will not be able in any case, to establish links between any space accessible through internet and the Web, unless it has prior expressed and written consent by Medicos del Mundo.

8. - DURATION

The duration of the given general terms of use of this web has indefinite character and will remain valid while the portal is active. The user recognizes having read the Legal Notice and accepts its contents.

Accordingly, Medicos del Mundo can modify the content of the given Legal Notice at any time, with the end of suit it to future legislative or technological changes. These modifications will be considered efficiently notified from the web being valid from this moment onwards.

9. - APLICABLE LAW
The given Legal Notice is ruled with the Spanish legislation. In case of a disruption or controversy related to the interpretation or application of it, the parts are subjected, renouncing expressly to any charter, to the Courts of the city of Madrid.
